
The Justice ruled the dismissal of the Brazilian doctor Juliana Magalhaes in the case of the death of model Emmily Rodrigues, which occurred during a VIP party in the Retiro neighborhood of Buenos Aires. Judge Luis Schegel, from the Criminal and Correctional Court number 31, considered that Magalhaes was not responsible for the model's death.
The judge explained that the doctor knew Emmily and Francisco Sáenz Valiente, who is accused of negligent homicide in conjunction with drug supply. He also highlighted that Magalhaes had shared the meeting with both and had medical knowledge that could have helped save the model after the fall from the sixth floor on March 30, 2023. According to the ruling, Magalhaes was charged with negligence for failing to provide timely medical assistance to Emmily after the fatal incident.
The ruling of the Justice argues that Magalhaes's profession as a doctor is not sufficient to accuse her under the National Penal Code. It is mentioned that, despite having consumed drugs and alcohol during the party, like others present, and the stressful situation experienced, it was demonstrated that at that moment she had little experience in the profession and was not specialized in psychiatric issues.
